THEATRE: DECIDING ON THE FORM OF THE PRODUCING ENTITY
Investors in a theatrical production want to limit their liability, particularly in the event that the production is not a commercial success. There are basically three types of business organizations that afford investors limited personal liability: the limited partnership, the corporation, and the limited liability company.
Historic Preservation -- Section 106 -- Archeological Principles
Although the National Historic Preservation Act (and Section 106 in particular) deals with the preservation of all historically and culturally significant sites, there are some special considerations for projects that affect archeological sites. Specifically, the Advisory Council on Historical Preservation (the regulating body established under the Preservation Act) created the Recommended Approach for Consultation on Recovery of Significant Information from Archeological Sites.
SPORTS LAW: NFL DRUG TESTING POLICY
The NFL's drug testing policy allows for testing of players for certain banned substances before they are employed, before the season begins, during a treatment or intervention program, and under any agreement between a player and his club if reasonable cause exists for such an agreement. Many of the substances on the prohibited list track those banned under the World Anti-Doping Code.
THEATRE: RAISING MONEY TO PRODUCE A PLAY OR MUSICAL, THEATRICAL SYNDICATION FINANCING, FRONT MONEY OFFERINGS
An offering to purchase an interest in a theatrical production company is exempt from New York securities laws if the offering is made for the sole purpose of raising front money and is initially made to less than five people. Thus, if a producer solicits and obtains an investment of front money from four people or less, the producer will not have to file documents with the New York Department of Law.
