Presenting and Objecting to Evidence

In order for a court to consider evidence presented in a case, the evidence must be properly presented to the court for admission. Presentation of evidence may be undertaken in a variety of ways.

Wire Fraud

The federal Wire Fraud statute was enacted more than 50 years ago. The statute includes both domestic and foreign wire transmissions.

INCEST

A person commits the offense of incest when he or she engages in sexual intercourse with a family member or a relative. A family member or a relative is usually defined as any ancestor or descendant by blood or adoption, any stepchild or stepparent while the marriage that created the step relationship exists, any parent's brother or sister by whole or half blood, any brother or sister of whole or half blood or by adoption, or the children of any brother or sister of whole or half blood or by adoption. The person must know that the other person is a relative. However, the relative does not need to be legitimate.

FEDERAL ENFORCEMENT OF CHILD SUPPORT

The Child Support Recovery Act of 1992 makes it a federal offense to willfully fail to pay a past due child support obligation for a child who resides in another state. A first offense under the Act is subject to a maximum penalty of six months in jail, to a fine, or both. Subsequent violations of the Act may be subject to a maximum penalty of two years in prison, to a fine, or both.

GAMBLING

A person commits the offense of gambling when he or she makes a bet on the result of a game or contest or on the performance of a participant in the game or contest; when he or she makes a bet on the result of a political nomination, appointment, or election, or on the success of any political nominee, candidate, or appointee; or when he or she plays and bets for money or for any item of value on any game that is played with cards, dice, balls, or other gambling devices.
